Partner Visa Onshore

It includes Partner Visa Onshore – Temporary Visa (Subclass 820) and Permanent Visa (Subclass 801).

Partner Visa - Subclass 820 (Temporary Visa)
This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 801).

With Partner visa 820 you can

  • live, work and study in Australia while we process your permanent Partner visa
  • travel to and from Australia as many times as you want
  • attend free English language classes provided by the Adult Migrant English Program if you are eligible
  • apply for access to Australia’s public health care scheme, Medicare.
  • You must

  • be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
  • have your spouse or de facto partner sponsor you
  • be in Australia when you apply for this visa and when we decide your temporary visa application. Family who apply with you must also be in Australia.
  • Apply for temporary partner visa 820

    You must be in Australia when you apply for this visa and when we decide your temporary visa application. Family who apply with you must also be in Australia.

    Partner visa - Subclass 801 (Permanent Visa)
    This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. It is usually only for people who currently hold a temporary Partner visa (subclass 820).

    With Permanent Partner visa 801 you can

    In addition to what you can do on your subclass 820 visa, you can:

  • live, work and study in Australia indefinitely
  • sponsor eligible family members to come to Australia
  • apply for Australian citizenship if eligible.
  • travel to and from Australia
  • if eligible, attend free English language classes provided by the Adult Migrant English Program
  • You must

  • hold a temporary Partner visa (subclass 820) or Dependent Child visa (subclass 445)
  • in most cases, continue to be in a genuine and ongoing relationship with your sponsor.
