Partner Visa Offshore

It includes Partner Visa Offshore – Provisional Visa (Subclass 309) and Migrant Visa (Subclass 100).

Basic Eligibility
You must be in a genuine relationship with your spouse or de facto partner who is:
Partner visa - Subclass 309 (Provisional Visa)
This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 100).

With Partner visa 309 you can

  • live, work and study in Australia while we process your permanent Partner visa
  • travel to and from Australia as many times as you want
  • attend free English language classes provided by the Adult Migrant English Program if you are eligible
  • apply for access to Australia’s public health care scheme, Medicare.
  • You must

  • be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
  • have your spouse or de facto partner sponsor you
  • be outside Australia when you apply for this visa. Family who apply with you must also be outside Australia.
  • Apply for provisional visa 309

    You and any family members or dependent child applying with you must be outside of Australia when you apply for this visa.

    Travel

  • You can travel to and from Australia as many times as you want.
  • You must enter Australia before the date specified in your grant letter. The first entry date is generally set at 12 months from the date of visa grant.
  • How long you can stay

    You can stay in Australia until your permanent Partner visa (subclass 100) application is finalised or you withdraw your application.

    Partner visa - Subclass 100 (Migrant Visa)
    The visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, live in Australia permanently. It is usually granted to people who hold a temporary Partner visa (subclass 309).

    With Partner visa 100 you can

    In addition to what you can do on your subclass 309 visa, you can:

  • live, work and study in Australia indefinitely
  • sponsor eligible family members to come to Australia
  • apply for Australian citizenship if eligible.
  • travel to and from Australia
  • If eligible, attend free English language classes provided by the Adult Migrant English Program
  • You must

  • hold a temporary Partner (Provisional) visa (subclass 309) or Dependent Child visa (subclass 445)
  • in most cases, continue to be in a genuine and ongoing relationship with your partner
  • How long you can stay

  • This is a permanent visa.
  • You become a permanent resident on the day you have been granted the visa.
  • Travel on migrant visa 100

  • You can travel to and from Australia as many times as you want for 5 years from the date we grant this visa. This is as long as the travel facility on this visa remains valid.
  • If you want to travel after the initial 5-year travel facility you will need to apply for and be granted a Resident Return (RRV). This will allow you to travel to Australia as a permanent resident.
