Fake Documents for Australian Visa

Today, I will briefly explain the consequence of giving fake documents for Australian visa application or to the Tribunal or any other assessing authority performing a function under the Migration Act.

It does not matter who lodged your visa application whether it’s an overseas agent who lodged your visa application or a registered migration agent in Australia, it’s you who is going to be held responsible for it. It’s you who is giving that document to the department or any other body performing a function under the Migration Act. Your visa can be cancelled for non-compliance with s103 of the Migration Act.

We have seen sometimes overseas agents have submitted counterfeit/changed transcript with better grades with a visa application and the student does not even know that the agent has submitted a bogus document on his behalf. The visa gets approved and the student happily landed in Australia. During the routine checks by the education provider or the department picks up the bogus documents and the student says he does not know about this changed transcript. Bad luck guys, if the department makes the decision after considering your response, it will proceed to cancel your visa. You can’t get away just by saying your agent provided the particular document without you knowing about it.

Section 103 prohibits a person from giving a bogus document or causing a bogus document to be given, to an officer or to a tribunal performing a function or purpose under the Act.
Two examples of non-compliance with s103

A person fails to comply with s103 if:

• in a visa application or immigration clearance process, the person presents a counterfeit passport, birth certificate, marriage certificate or educational certificate or
• in a visa application or immigration clearance process, the person presents a genuine passport or birth certificate that belongs to someone else.
