The employer sponsorship visa Australia are designed for Australian employers to be able to recruit highly skilled workers either from overseas or from people temporarily in Australia. Where an employer has been unable to fill their recruitment needs from the Australian labour market or through their own training efforts, they are able to do so using overseas skilled employees.

You can apply for these visas in Australia or from offshore.

1. Temporary Skill Shortage Visa (subclass 482)

This visa enables employers to address labour shortages by bringing in skilled workers where employers can’t source an appropriately skilled Australian worker.

Temporary Skill Shortage Visa is a temporary visa and it can be granted for 1 to 4 years duration. Employees can only work with an associate entity unless exempted. Employee must work in the nominated occupation. If you need to change the employer, new nomination should be lodged with the new employer.

As a worker you must have the skills to perform the nominated occupation. Your occupation must be on Subclass 482 occupation list. The visa applicant must have 2 years of work experience in the occupation or a related field. For some occupations, there is a mandatory skill assessment requirement to be eligible to apply for this visa. Please check with migration professional if you need to have a skill assessment. There is no age limit for the visa applicant.

482 Temporary Visa holders must maintain adequate health insurance while in Australia.

What you can do when you have this visa

  • work in Australia for the length of your visa grant
  • study
  • travel to and from Australia as many times as you want while the visa is valid
  • if eligible, apply for a Australia permanent residence

The Subclass 482 Visa (TSS) has 3 different streams:

Short-term stream – You apply under this stream if your occupation is on Short-Term Skilled Occupations List (STSOL)

You can stay up to 2 years or up to 4 years.

Medium-Term Stream – You apply under this stream if your occupation is on Medium and Long-term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL)

You can work in Australia for up to four years.

Labour agreement stream – This visa is for skilled workers nominated by employers who have a Labour Agreement. It lets you live and work in Australia temporarily. Labour agreements are developed between the Australian Government (represented by the Department) and employers

As a holder of this visa you can get visa up to a maximum of 4 years, depending on the terms in the labour agreement.

This visa lets skilled workers, who are nominated by their employer, live and work in Australia permanently.

Employer nomination scheme visa subclass 186 is a permanent visa and you need an employer to nominate you. You must have an occupation on 186 Visa Occupation List. You must have the required skills and qualifications needed to perform the tasks of the nominated occupation. You will need 6 each in IELTS or equivalent score in other English language test.  You can be in Australia or outside Australia at the time of lodgement. You and family members must meet health and character requirements.

Usually, you must be under 45 years of age when you apply unless exempted.

The employer must be actively and lawfully operating a business in Australia. He must have a genuine need for a paid employee to fill a skilled position in their business. Business must be able to offer a skilled position that is full time and ongoing for at least 2 years. Employer must pay the Skilling Australians Fund levy for any nomination application you submit.

This is a permanent visa and with this visa, you can

  • stay in Australia indefinitely
  • work and study in Australia
  • enroll in Australia’s public health care scheme, Medicare
  • travel to and from Australia for 5 years
  • apply for Australian citizenship, if eligible

The Subclass 186 Visa ENS has 3 different streams

Direct Entry stream – As a Visa Applicant, you must have an occupation that is on the list of eligible skilled occupations. As a visa applicant you must have at least 3 years relevant work experience, unless you are exempt. You must have a positive skills assessment unless you are exempt. You must have competent English.

You must be nominated by an Australian employer whose business is actively and lawfully operating.

Labour agreement stream – This visa lets skilled workers who are nominated by their employer live and work in Australia permanently. The Labour Agreement stream might be for you if you currently work, or will work, for an employer who is party to a labour agreement.

You must currently work, or will work, for your employer under a labour agreement. You must have suitable English language skills, experience, skills and other attributes for the position. The labour agreement will provide guidance on these. You may be asked to get a skills assessment that shows you have the skills to work in the position.

Temporary Residence Transition stream – To apply for this visa, ​​​you must hold a 457, TSS or related bridging visa A, B or C. Usually, you must have worked for your employer full-time for at least three years. You must be nominated by the employer with which you have been working as a holder of 457 or TSS visa.

You must be nominated by an Australian employer whose business is actively and lawfully operating.

As a visa applicant, you must have an occupation on a relevant skilled occupation list. You must have at least 3 years work experience on a full-time basis in your nominated occupation and at the skill level required for the nominated occupation. You need to have a positive skill assessment at the time of application. You must be under 45 years of age. You must have at least Competent English to be granted this visa.  You and family members must meet health and character requirements.

The employer must be located within a designated regional area of Australia.

With this visa, you can

  •   live, work and study only in designated regional areas of Australia for 5 years
  •   travel to and from Australia for 5 years
  •   if eligible, apply for permanent residence after 3 years from the time your visa is granted
